“Politicians must work to find exits to end the Libyan crisis and political and social division…in this frame, Justice and
Construction party is inspecting some ideas that aims at redirecting everybody to talking and searching for a political solution that ends fight between Libyans”.
Mentioned above, is a part of statement of the party’s leader, Mohamed Swane, in November 2014. The statement reflected the strategy the party adopted during the past year when it worked continuously to find a way to stop the bloodshed and ends the split.
Justice and Construction party isn’t a state institution; it didn’t lead a government or head a parliament in Libya since it was founded. The party is like all Libyan parties, has the same leadership that is new in the political field in the pluralist partisan form.
Whatever, the party could establish a clear-goal partisan work, with morals of honesty, loyalty, commitment to the patriotic good, respecting Shura principles, and values of democracy. Anyone who fairly observes the party’s history will notice stability in the values that guided its steps, statements of its officials and stances in local and international meetings since its foundation in March 2012.
All who attack the party nowadays can’t prove one preachment to any laws, degradation to Libyan institutions, or give an example to a preachment to any value shared by most Libyans.
The party is a democratic institution:
The party elected its chief and half of its high commission in its foundational conference in March 2012, and new chief and high commission were elected in April 2014.
The party developed many additional bylaws; it issued rules of general organizational structure, and a list of the General Conference of the party, rules of procedure of the parliamentary bloc, and a list of general structure of branches and job descriptions, and financial and administrative rules. The party “issued the guide to structural literacy” in which, it defined the philosophy of the party, its values and attitudes in economic, political and social dimensions, in addition to the technical, media, legal, environmental, management and institutional dimension.
This evidence is considered the main document that forms the party and is a part of the training content that should be generalized to members to enhance their integration. The party issued more than 132 political statements and tens of media statements since its foundation in March 2012.
These statements proved its supportive stance to the democratic path, respect to Human rights and refuse to violence in all forms. The party refused all trials to mess with the unity of Libya and was proud of population and cultural variety in the nation. It also supported the authority in charge whenever it was possible and opposed it when it may have caused harm.
Releases and stances of the party asserted on the dialogue and called for it and responded to all invitations to it. It called for the commitment to the political agreement and national accord. It refused all types of physical and verbal violence, and the use of arms outside the state’s control.
Brain storming before every statement is difficult, as the party usually responds to updates in less than 24 hours. Sometimes it takes more; for example, the recent statement number (26 for the year 2015), took 48 hours, as debate prolonged around every word and sentence in it.
Whenever an event requires the issuance of a statement or a news release, a statement is drafted, and then displayed to the leadership which includes 14 leading figures; the party chief, head of the Higher Commission, Vice President, Executive Director, Head of Corporate Communication Department, Head of the Political Department, head of the parliamentary bloc and 7 advisers.
Each statement is subjected to a process of dissecting before being released by consensus or by voting when consensus is out of reach. Debates within the party may occur around many situations and it take different dimensions; the demands of submitting it to the supreme body, or investigation for the issuance mechanism, or submitting the statement to the Legal Committee, or even quitting as objection message.
Showing this work mechanism isn’t about flaunting institutions, election candidates or companies do, it is a demonstration to the work mechanism inside the party in an environment that is new to institutionalism, and it gives clear evidence to who wants to see that the party’s project isn’t in the hands of a member or group of members. The party is a project to build a nation by the will of who have been burned by fire of tyranny, prisons and exiles for demanding a nation in which Libyans enjoy a decent life, and enjoy the goods of Libya fairly.
The decision-making mechanism in the party, which seems complex and crippling for some hasty people, is the only guarantee for the maturity of party decision, which contributes to the maturing of the grand national vision. It is the only guarantee for the cohesion of the party, and the legitimacy of its decisions, an example that we want to have in public life, and in the institutions running lives of Libyans.
Articles that party announced could have stated the mandate of the president or President of High Authority, or media, issuing statements and declarations, without audit, or review, but partisan organization chose the complex long way, believing that the country does not allow hasty speech. We Can not open the field in front of any individual, or a small group, no matter how mature or responsible they are to talk about public affairs without extensive discussions of practical experience, which made all party’s positions and statements consistent with the principles, and with the vision of the party’s supreme interest.
It was possible to formulate loose texts to give those in charge inside the party freedom of and make quick attitudes and immediate reaction. But the desire for institutional and national work, with firm conviction, made decision makers inside the party are clinging to that complex institutionalize that restrict individual freedom, and grants the decision to different bodies.
It falls within the same context the party’s relationship with its bloc inside the National General Congress, which left her the freedom to choose what represents their chosen segments of the electorate, and respects the decisions of GNC even if not consistent with leaders’ decisions or The convictions of its senior leadership.
Even though it is hard to believe in seriousness of this choice, and the attempt of some people to exploit it to cause disturbance inside the party, it was irreversible decision and choice no one has the right to modify.
The party participated in GNC’s elections, its block had effective role in the political scene, they were trained during training course held in Benghazi in July 2012, attended by members of the block, some members of GNC.
The party voted to elect the prime minister, without any conditions concerning their affiliations, agreed to participate in Ali Zidan’s government, from which the party later withdrew.
The party welcomed the elections of House of Representatives (HoR), which it didn’t circumvent the law to nominate for, it required correction for parliament’s position when it violated receipt and delivery procedures. And when constitutional court announced its convictions, the party asked all parties to use those convictions as a bridge for solution.
The party practically rooted the principals of respecting judiciary bodies and its independence by accepting convictions of constitutional circles inside supreme court, in the know case of Ahmed Meitiq government, and the case of HoR invalidity.
When the democratic course in Libya faced coup attempts supported by regional parties, the party had opposing position against those attempts, and stood in the same line with legitimacy to protect democratic course. The party organized outside tours to explain Libyan crisis to protect democracy and prevent international and political isolation of revolutionary current.
The party denied terrorism accusations of revolutionary current promoted by national and regional parties and paid media. The party welcomed dialogue called by Tareq Mitri, former UN envoy to Libya, took the same attitude toward process mediated by Bernardino Leon.
The party asked all parties to weight the high interest of the country, the head of the party participated in all dialogue rounds and encouraged all parties to participate, played important role in approaching different points of views and putting solutions and initiatives.
This type of political practice controlled by principals and adhering of the state and citizen’s interest who believe in peaceful circulation of power, put those who put commercial and political interests in front of people.
Upholding the values of justice and fairness:
Those stations could be monitored by those who want to see things with clear mind apart form biases, anyone could see two important points:
First: loyalty to Shura, democratic, pluralism, and peace principles and uphold the supreme interest of the country. Those positions and short history made clear that the party is always seeking the interest of the state wherever it is, not seeking power or post that puts country interests in specific size that changes according to regional, national and international balances.
Second: consistency of those positions with written principles of the party, and chosen political line. Taking part in all government, elections are tied to how far they maintain our interests, and how far they are consistent with our vision of state interest, and not based on electoral, financial interests.
Integration in dialogue and convergence between the sons of the nation, reunification, upholding justice and equity values and interest, and reach out to those who wanted to achieve something from it; is a fixed strategic choice not tactical position doomed with vessels of interest and affiliations.
The extract of all this talk is that the Justice and Construction Party, was, still, and will remain Libyan political party serving Libya, and seeks for the benefit of its citizens, and its unity clinging to a state based on justice and equity, but not a group that wants to be served by the country, or take the state as a cow generating income and use it for its sustainability on the expense of homeland and the citizens. This is the course of justice and construction party. We correct our course whenever we see mistakes, and worked hard In accounting and replacing who is responsible, if he falls short of the extent of liability.
